The Company did not have adequate internal controls designed to ensure all necessary non-financial reports are filed timely as the Company did not submit the annual report on foreign taxes assessed, reimbursed and not reimbursed by a foreign government on or before the respective deadline. Criteria or specific requirement: The U.S. Department of State requires that agencies collect and report information on the amount of taxes assessed, reimbursed and not reimbursed by a foreign government against commodities financed with funds appropriated by the U.S. Department of State, Foreign Operations and Related Programs Appropriations Act of 2011. One of the reporting requirements is for the recipient to submit an annual report on the amount of foreign taxes charged by a foreign government on commodity purchase transactions valued at $500 or more financed with United States foreign assistance funds under the cooperative agreement during the United States Fiscal Year (October 1 - September 30), and the amount reimbursed and unreimbursed by the foreign government. This report must be submitted on or before November 16 for each foreign country in the amount of foreign taxes charged. Questioned Costs: None noted. Cause and Effect: The annual foreign tax report was submitted on December 5, 2019 and is considered not filed timely. As a result, the Company was not in compliance with its contractual reporting requirements for the federal program. The Company?s current policies and procedures call for tracking its annual financial and non-financial reporting deadlines. However, the Company did not adequately follow the prescribed procedures in monitoring the timeliness of annual reporting. The non-timely reported data may hinder awarding agency?s sponsoring decisions and potential future funding decisions. Recommendation: We recommend that the Company strengthen its procedures over review of the contractual reporting requirements. These procedures could include a checklist identifying all annual financial and non-financial reporting requirements and respective due dates, and assigning monitoring responsibilities for tracking deadlines to multiple individuals. Management?s Views and Corrective Action Plan: Change in staff responsibilities delayed filings of the annual foreign tax report. The additional staff assigned to the monitoring of reporting deadlines in fiscal year 2020 will ensure that future annual reports will be completed and filed in a timely fashion.
