Suspension and Debarment Prior to entering into subawards and covered transactions with federal award funds, recipients are required to verify that such contractors and subrecipients are not suspended, debarred, or otherwise excluded. "Covered transactions" include, but are not limited to, contracts for goods and services awarded under a nonprocurement transaction (i.e., grant agreement) that are expected to equal or exceed $25,000. The verification is to be done by checking the SAMs exclusions, collecting a certification from that vendor, or adding a clause or condition to the covered transaction with that vendor. It is the School Corporation's policy that they will either require a certification from the vendor or check the exclusion list prior to entering a covered transaction. The School Corporation entered into three covered transactions during the audit period, and it was unable to provide evidence that it followed its policy for two of those transactions. The total purchases made from these two vendors totaled $93,895. FINDING 2023-003 Subject: COVID-19 - Education Stabilization Fund - Reporting Federal Agency: Department of Education Federal Program: COVID-19 - Education Stabilization Fund Assistance Listings Numbers: 84.425D, 84.425U Federal Award Numbers and Years (or Other Identifying Numbers): S425D200013, S425D210013, S425U210013 Pass-Through Entity: Indiana Department of Education Compliance Requirement: Reporting Audit Findings: Material Weakness, Modified Opinion Condition and Context The School Corporation was required to submit annual data reports to the Indiana Department of Education (IDOE) via JotForm, a form/report builder. Data to be submitted included, but was not limited to, current period expenditures, prior period expenditures, and expenditures per activity. During the audit period the School Corporation submitted two ESSER I reports, two ESSER II reports, and two ESSER III reports, for a total of six reports. The reports were prepared by one employee without an oversight or review process in place to prevent, or detect and correct, errors. Furthermore, the data reported on four of the six reports could not be traced back to underlying records; therefore, the accuracy and completeness of the reports could not be verified. The following errors were identified: ESSER I, Year 2 Report The key line item, "Operational Continuity and Other Allowed Uses - Personnel Services - Salaries," was overstated by $20,648. ESSER I, Year 3 Report The key line item, "Addressing Physical Health and Safety Uses - Personnel Services - Salaries," was understated by $14,685. Cause A proper system of internal controls was not designed by management of the School Corporation which includes a segregation of key functions. Embedded within a properly designed and implemented internal control system should be internal controls consisting of policies and procedures. Policies reflect the School Corporation's management statements of what should be done to effect internal controls, and procedures should consist of actions that would implement these policies. Effect Without the proper implementation of an effectively designed system of internal controls, the internal control system cannot be capable of effectively preventing, or detecting and correcting, material noncompliance. As a result, reported amounts could not be traced back to the underlying records. The Reports were prepared by one employee without an oversight or review process in place to prevent, or detect and correct, errors. During the fiscal years 2017-2018 and 2018-2019, the Service Center solicited, evaluated and awarded bids for bread, milk, and other products on behalf of its members. There was inadequate oversight performed by the School Corporation of the procurement and suspension and debarment procedures of the Service Center. An effective internal control system was not in place at the School Corporation in order to ensure compliance with requirements related to the grant agreement and the Procurement and Suspension and Debarment compliance requirement. Procurement The bids for bread and milk were originally awarded for fiscal year 2016-2017, and each contract included a clause stating that the contract could be extended for three additional twelve (12) month periods by mutual written agreement. The Service Center could not provide documentation of the mutually agreed upon contracts for the extensions of the bread bid for the 2017-2018 or 2018-2019. The Service Center also could not provide documentation of the mutually agreed upon contract for the extension of the milk bid for 2018-2019. Suspension and Debarment The bids for bread and milk were originally awarded for fiscal year 2016-2017, and each contract included a clause stating that the contract could be extended for three additional twelve (12) month periods by mutual written agreement, along with a clause noting that the vendor was not suspended or debarred. The Service Center could not provide documentation of the mutually agreed upon contracts for the extensions of the bread bid for 2017-2018 or 2018-2019. The Service Center also could not provide documentation of the mutually agreed upon contract for the extension of the milk bid for 2018-2019. Therefore, the Service Center did not provide documentation that procedures were performed to verify the vendors were not suspended or debarred prior to entering into covered transactions with these vendors. The lack of controls and noncompliance were systemic issues throughout the audit period. School Corporation An effective internal control system was not in place at the School Corporation in order to ensure compliance with requirements related to the grant agreement and the Procurement and Suspension and Debarment compliance requirement. Procurement The School Corporation utilized two vendors, who were not part of the Service Center, for which the total purchases for 2017-2018 and 2018-2019 were within the small purchase threshold ($3,500-$150,000) and the School Corporation did not obtain quotes or maintain documentation for the rationale of selecting each vendor for food purchases. The lack of controls and noncompliance were systemic issues throughout the audit period. The Service Center could not provide documentation of the mutually agreed upon contracts for the extensions of the bread bid for the 2017-2018 or 2018-2019. Suspension and Debarment The bids for bread and milk were originally awarded for fiscal year 2016-2017, and each contract included a clause stating that the contract could be extended for three additional twelve (12) month periods by mutual written agreement, along with a clause noting that the vendor was not suspended or debarred. The Centralized School Lunch Treasurer will get all bids for approved vendors from IAESC Procurement and give copies to each head cook at the beginning of the school year. ? The head cook of each building will check invoices/receipts to make sure correct cost was charged and sign approving invoices/receipts are accurate before giving to Centralized School Lunch Treasurer to process payment.
