The Project did not deposit the residual receipts of $12,385 into a separate residual receipts bank account within 60 days of the yearend as required by the regulatory agreement. Criteria: Section 5(c) of the HUD regulatory agreement requires ?Within sixty (60) days after the end of each fiscal year, any residual receipts realized from the operation of the mortgaged property shall be deposited in a separate residual receipts accounts.?Effect: Residual receipts were not funded in a separate bank account.as required per the HUD regulatory agreement. Questioned Costs: $ --- Context: As a result of the delay in renewing the annual Project Rental Assistance Contract (PRAC) until January 2022, the HUD tenant assistance for the months of September 2021 ? December 2021 were not received until January 12, 2022. The Project delayed expenses since they did not have the funds from the HUD tenant assistance resulting in residual receipts in accordance with the HUD calculation. Cause: The PRAC renewal was delayed until January 2022 resulting in the late receipt of the HUD tenant assistance for the four months of September 2021 ? December 2021. Recommendation: The Project should fund the residual receipts in a separate bank account as required by the regulatory agreement. View of Responsible Officials and Planned Corrective Actions: Management disagrees with the finding since they did not receive the HUD tenant assistance in a timely manner. Management has requested a waiver from HUD. Response: On September 16, 2022, the Project received from HUD a written one-time waiver to the 2021 required $12,385 residual receipts deposit.

FINDING NO. 2021-001 Section 811 (Capital Advance Loan), CFDA NO. 14.181 Condition: The Project did not deposit the residual receipts of $12,385 into a separate residual receipts bank account within 60 days of the yearend as required by the regulatory agreement. Department of Housing and Urban Development HUD PROJECT NO. 122-HD063-CMI-NP, respectfully submits the following Corrective Action Plan for the year ended December 31, 2021. Name and address of independent public accounting firm: Suchan & Associates, An Accountancy Corporation, 8588 Utica Ave. Suite 100, Rancho Cucamonga, California 91730. Audit Period: January 1, 2021 through December 31, 2021 The finding from the 2021 Schedule of Findings and Questioned Costs is discussed below. The finding is numbered consistent with the number assigned in the schedule. Section A of the Schedule, Summary of Audit Results does not include findings and is not addressed. FINDINGS-FINANCIAL STATEMENTS AUDIT None FINDINGS AND QUESTIONED COSTS-MAJOR FEDERAL AWARD PROGRAMS AUDIT DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FINDING NO. 2021-001 Section 811 (Capital Advance Loan), CFDA No. 14.181 Recommendation: The Project should fund the residual receipts shortage as soon as possible and make sure that any residual receipts are deposited into a separate bank account within 60 days of the yearend as required by the HUD regulatory agreement. Action Taken: On September 16, 2022, the Project received from HUD a written one-time waiver to the 2021 required $12,385 residual receipts deposit.
