As per Amherst Glen Senior Apartments, Inc., HUD Project No. 014-EE270?s HUD Regulatory Agreement, section 5(c), any residual receipts realized from the operation of the mortgaged property shall be deposited in a separate residual receipts account within 60 days after the end of each fiscal year. Condition ? As of December 31, 2019, Amherst Glen Senior Apartments, Inc., HUD Project No. 014-EE270 realized surplus cash in the amount of $15,361 of which was not properly deposited into a residual receipts account within 60 days after year-end. Context ? This finding was identified during compliance testing procedures. Effect ? Amherst Glen Senior Apartments, Inc., HUD Project No. 014-EE270 is not operating within compliance with section 5(c) of its Regulatory Agreement with HUD. Cause ? The finding was a result of oversight, as well as a function of turnover of experienced personnel within Amherst Glen Senior Apartments, Inc., HUD Project No. 014-EE270. Recommendation ? All surplus cash determined at December 31, 2019 must be deposited into a residual receipts account to ensure compliance with Amherst Glen Senior Apartments, Inc., HUD Project No. 014-EE270?s Regulatory Agreement. Management?s Resolution ? Management plans to deposit the required amount into the residual receipts account immediately.

Comments on the Finding and Recommendation This was an isolated occurrence due to oversight and turnover at our Company. The surplus cash will be remitted into a residual receipts account immediately and will be deposited timely going forward should the Company realize surplus cash in future years. b. Action Taken or Planned on the Finding Internal surplus cash calculation will be prepared at year-end prior to the audit. Any surplus cash realized will be transferred to the residual receipts account within the 60 days required by our HUD Regulatory Agreement.
