Selection from the Waiting List Other Matter / Significant Deficiency U.S. Department of Housing and Urban Development CFDA #: 14.871 - Housing Choice Voucher Program CRITERIA 24 CFR 5.410 requires all families admitted to the housing choice voucher program must be selected from the waiting list according to the Authority?s own selection policy. CONDITION The firm examined a sample of tenant files for the Housing Choice Voucher Program and tested key internal controls over compliance with the eligibility requirements of the program. Of the 15 files tested, we noted one (1) instance in which an applicant was housed from the waiting list out of order. CAUSE The Authority did not follow it?s policy pertaining to preferences for new admissions. EFFECT OR POTENTIAL EFFECT The Authority is required to have written policies in its HCVP administration plan for selecting the applicants from the waiting list and must follow those procedures. If the Authority does not follow those policies, an ineligible tenant may be admitted to the program. QUESTIONED COSTS None identified. CONTEXT We selected a sample of 2 voucher holders from a population of 13. This was not a statistically valid sample. RECOMMENDATION The firm recommends the Authority update it?s waitlist preferences in order to accommodate current public housing residents who need specific accommodations that are not available in the Authority?s public housing units.AUDITEE?S RESPONSE AND PLANNED CORRECTIVE ACTION See Corrective Action Plan.

Finding 2020-001 - Selection from the Waiting List Planned Implementation Date of Corrective Action - 04/22/2021 Person responsible for Corrective Action - Ditha Alonso, Executive Director Steven Stancek, S8 Leased Housing Officer Glenn Reed, PH Occupancy Officer In conducting the Audit, Marcum LLP Accountants discovered that a Public Housing to Section 8 HCV transfer occurred outside of the normal waiting list process required by HUD in the Code of Federal Regulations at 24 CFR 982.204. This program to program transfer was done as a Reasonable Accommodation for a current disabled LHA tenant with special needs and was thought to be within the scope of guidance pursuant to Section 504 of the Rehabilitation Act of 1973. In response to this finding, LHA has taken action to amend both the Section 8 HCV Administrative Plan and Public Housing Admissions and Continued Occupancy Polices to allow for such transfers should the need arise again in the future. To do so, LHA staff consulted with New Hampshire Legal Assistance (NHLA) staff for guidance on establishing waiting list Preferences that create a more clearly defined and documentable path for those tenants who might otherwise be displaced from LHA Programs absent such an option. It was recommended that LHA devise two new waiting list Transfer Preferences. One Transfer Preference addresses Section 504 Reasonable Accommodations for current LHA tenants and program participants with mental, physical or developmental disability driven needs. The other Transfer Preference is for current LHA tenants and program participants impacted by Domestic Violence, Dating Violence, Sexual Assault or Stalking pursuant to the Violence Against Women Act (VAWA). LHA will apply appropriate weighted ranking of all preferences to assure highest applicant priority for such transfers as time is often of essence. The LHA Board of Commissioners at its April 22, 2021 meeting adopted by a unanimous vote Resolution #954 which implements these waiting list Preferences for each Program. The employee program managers listed will ensure that all required documentation is filed henceforth when the need for such transfers arises. The Executive Director will provide oversight for such transfers for policy compliance.
